- Sensational Orders Issued Under the Senior Citizens Act
Uravakonda, Anantapur District: The Revenue Divisional Officer (RDO) and Presiding Officer of the Tribunal in Guntakal have issued sensational orders under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. Faulting the actions of the elder son, who not only neglected his elderly mother but also fraudulently got her property registered as a Gift Deed in the name of his minor daughters, the RDO ordered the cancellation of the said Gift Deed.
The details of the case are as follows:
Case Background:
An elderly woman named Vadde Adhilakshmi (73) from Patha Peta, Uravakonda Village, approached the Guntakal RDO/Maintenance Tribunal. She alleged that her elder son, Vadde Kishore Kumar, a resident of Bengaluru, failed to take proper care of her and attempted to seize her property through fraud.
Fraud in Property Transfer:
After the death of Adhilakshmi's husband, she became dependent on her elder son. She stated that the son assured her that the residential house property would be transferred to her name and took her to the Sub-Registrar's office. However, Adhilakshmi complained that, unbeknownst to her, the son fraudulently got the residential house property (Document No. 5578/2022) registered as a Gift Deed in the name of his two minor daughters (Adhilakshmi's granddaughters).
She informed the Tribunal that the son forcefully acquired the property by exploiting her illiteracy and old age, and thereafter completely neglected her, failing to provide maintenance and care.
Tribunal Inquiry and Decision:
The Tribunal, presided over by RDO A.B.V.S.B. Srinivas, B.Tech., L.L.M., inquired into the case (Case No. 1922/2024).
* Neglect Proven: The inquiry established that the respondent No.1 exploited the complainant's old age and illiteracy to obtain the Gift Deed, and subsequently failed to provide basic amenities and care to his mother, which was clear from the evidence on record.
* Violation of Act: The Tribunal stated that according to Section 23(1) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, if a Senior Citizen transfers any property and the recipient fails to provide maintenance and care, the transfer shall be deemed to have been made by 'fraud, coercion, or undue influence'.
* Orders: The RDO ruled that the Registered Gift Deed dated 03-11-2022 is declared null and void as evidence of the son's neglect and fraudulent acquisition of the property.
Directions to Registrar:
In accordance with these orders, the Tribunal directed the Sub-Registrar, Uravakonda, to make the necessary entries in the registration records indicating that the cancelled Document No. 5578/2022 has been revoked by the Tribunal's order. The Tribunal also warned that any further neglect or harassment of the elderly mother would invite strict legal action.
The judgment was pronounced in open court on 28-10-2025. These orders once again prove how much protection this Act provides for Senior Citizens to safeguard their property rights.
